The state of Illinois is making it easier for consumers to get out of their cell phone contracts.  A new “lemon law,” which just passed the House of Representatives, carries a three strikes rule for wireless providers.  If a handset requires repair or replacement three times, signees can cancel their contract without penalty.

Additional clauses allow consumers to upgrade or downgrade their cell phones while paying the same fees commonly found with promotional discounts.

The bill isn’t law yet.  It still needs to pass through the Senate and finally the Governor. Although this law will only apply to Illinois residents, it may set precedent for other states to follow.

Is such a law good for consumers?  If the bill passes, will wireless providers experience a rise in replacement claims?  Imagine being able to break your phone on purpose to get out of a long-term contract.

In due time, we’ll eventually find out if a law can be effective.
